History

This incident occurred during the conquest of Mecca (A.H. 8/M. 630). A woman from the Mahzum tribe committed theft, and once the crime was established, the application of the punishment of cutting off the hand was brought up. The woman's tribe was filled with great anxiety. Who could intercede with the Prophet Muhammad on this matter? Eventually, they decided to involve Usama ibn Zayd, whom the Prophet loved very much. Usama attempted to intercede for the woman. The Prophet's face changed instantly, and he said: 'Are you interceding for one of Allah's punishments?' He then stood up and delivered a sermon: 'The previous nations were destroyed for this reason: If a strong person among them stole, they would let him go, but if a weak person stole, they would punish him immediately. I swear by Allah, if Fatima, the daughter of Muhammad, were to steal, I would cut off her hand as well.' This hadith is the strongest declaration of equality before the law in Islamic law, indicating that no privileges are accepted. The Prophet clearly expressed that he would not exempt even his own child from this principle. It also demonstrates that intercession is invalid concerning punishments (hudud).
